End User License Agreement (EULA)

Welcome to Levelz365! This End User License Agreement (“EULA”) governs your use of the Levelz365 app. By downloading, accessing, or using Levelz365, you agree to be bound by this EULA. If you do not agree to these terms, you must not use the app.

1. Acceptance of Terms

By accessing or using Levelz365, you confirm that:

   • You have read, understood, and agree to comply with this EULA.

   • If you are under the age of 18, you have obtained parental or legal guardian consent to use the app.

2. License Grant

Levelz365 grants you a limited, non-exclusive, non-transferable, and revocable license to:

    • Download, install, and use the app for personal, non-commercial purposes.

You may not:

    • Copy, modify, distribute, sell, or lease any part of the app.

    • Reverse-engineer, decompile, or attempt to extract the source code of the app, except as required by law.

3. User Accounts

To access certain features of Levelz365, you must create an account.

    • Account Information: You must provide accurate and complete information and keep it updated.

    • Security: You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect unauthorized access.

    • Termination: We reserve the right to suspend or terminate accounts for violations of this EULA or harmful activity.

4. Player Data and Privacy

• Data Ownership: Player statistics, journal entries, and performance data remain your property.

    • Privacy: Your data is private and shared only with your designated coach unless you explicitly share it on the app’s social media.

    • Content License: By sharing content on social features, you grant Levelz365 a non-exclusive, worldwide, royalty-free license to display and distribute the content within the app.

5. Acceptable Use

You agree not to:

    • Use the app for unlawful, harmful, or fraudulent purposes.

   • Share content that:

    • Is offensive, defamatory, obscene, or harmful.

    • Violates the rights of others, including intellectual property rights.

    • Contains viruses, malware, or other harmful code.

We reserve the right to monitor and remove inappropriate or unlawful content.

6. Intellectual Property

• The app’s design, features, and functionality are the intellectual property of Levelz365.

     • User-generated content remains your property; however, by posting within the app, you grant us a license to use and display it.

     • Unauthorized use of our intellectual property is strictly prohibited.

7. Limitation of Liability

Levelz365 is provided “as-is” and “as-available,” without warranties of any kind.

     • We do not guarantee uninterrupted access or error-free functionality.

     • We are not responsible for:

     • Loss of data, revenue, or business opportunities.

     • Damages resulting from use of the app, including reliance on data or content within the app.

Your use of the app is at your own risk.

8. Indemnification

You agree to indemnify and hold harmless Levelz365, its affiliates, and its employees from any claims, damages, or expenses arising from:

     • Your use of the app.

     • Your violation of this EULA.

     • Content you share that infringes the rights of others.

9. Third-Party Services and Links

Levelz365 may integrate with third-party services or contain links to external websites.

     • We are not responsible for the availability, accuracy, or content of third-party services or websites.

     • Your use of third-party services is subject to their respective terms and policies.

10. App Store Terms

• This EULA is between you and Levelz365, not the app store provider (e.g., Apple, Google).

      • The app store provider has no responsibility for support, maintenance, or claims related to the app.

      • You must comply with applicable app store terms and conditions when using Levelz365.

11. Data Collection and Use

• Data Collection: We collect player statistics, app usage data, and account information.

      • Data Usage: Data is used to provide app functionality and improve services.

      • Third-Party Tools: We may use analytics tools or integrations for data processing.

12. Governing Law

This EULA is governed by the laws of the United States and the State of California. Any disputes arising from this EULA will be resolved exclusively in the courts of California.

13. Updates to this EULA

We may update this EULA to reflect changes in our services or legal requirements. Continued use of the app after updates constitutes acceptance of the revised EULA.
